Carl Abbott, age 67, was struck by a school bus driven by a Palm Beach County School District employee on June 30, 2008, while crossing in a designated crosswalk, resulting in closed head injury, traumatic brain injury, subdural hematoma, and subarachnoid hemorrhage.

The Palm Beach County School Board is authorized to appropriate $1.9 million total, payable to David Abbott as guardian, distributed as $211,111.11 annually from 2015 through 2022, and $211,111.12 in fiscal year 2023-2024.

Carl Abbott died in June 2014; David Abbott as guardian is guaranteed a minimum payment of $633,333.33 (three annual payments) despite the original arrangement to cease payments upon Carl Abbott's death.

Attorney fees, lobbying fees, costs, and similar expenses may not exceed 25 percent of the total $1.9 million awarded.

The compensation provided under this act, combined with the $100,000 already paid under statutory liability limits, constitutes sole compensation for all present and future claims arising from the incident.
