City of Jacksonville is authorized to pay $3.3 million total to the Aubrey Javaris Stewart Special Needs Trust as compensation for negligence resulting in a 15-year-old's paralysis from a fallen tree limb on June 27, 2011.

Initial payment of $1.2 million (less Medicaid lien repayment) is due by first November 1 after bill passage, with additional payments of $1 million, $600,000, and $500,000 at one-year intervals thereafter.

City had received four complaints about the dangerous tree condition between September 2010 and May 2011 but failed to address the hazard before the incident.

Attorney fees, lobbying fees, costs, and other related expenses may not exceed 25 percent of the amount awarded under the act.

City of Jacksonville must repay the Agency for Health Care Administration for all unreimbursed Medicaid medical payments before disbursing settlement funds to the claimant.
