North Brevard County Hospital District authorized to pay $395,000 to Roy Wright, Ashley Wright, and their guardian Tucker Wright to settle a negligence lawsuit against Parrish Medical Center related to complications during Tucker Wright's birth on July 16, 2009.

Nurse Cara Starkey negligently rotated the fetus's head during delivery, causing a brachial plexus injury to Tucker Wright's right arm that resulted in permanent functional deficits and required two surgeries.

Total settlement amount of $595,000 includes $200,000 previously paid under Florida's statutory liability limits, with this appropriation covering the remaining $395,000.

Attorney fees, lobbying fees, costs, and similar expenses may not exceed 25 percent of the $395,000 award.

Combined payments satisfy all present and future claims related to the negligent act; act takes effect upon becoming law.
