HB 5201 Summary

• Establishes that state and counties share joint responsibility for funding juvenile detention care, with nonfiscally constrained counties contributing 57% of total shared detention costs beginning in fiscal year 2016-2017.

• Defines "fiscally constrained county" as counties in rural areas of opportunity designated by the Governor or counties where a mill raises no more than $5 million in revenue based on certified school taxable value.

• Requires the state to pay all detention costs for juveniles in fiscally constrained counties and for out-of-state detainees.

• Directs the Department of Revenue to review county juvenile detention payments and deduct unpaid obligations from state distributions to counties under section 218.23, while protecting bond obligations issued before July 1, 2015.

• Takes effect July 1, 2015.
