CS/CS/HB 7071 - Traffic Control Summary

• Requires notification of traffic infraction detector violations be sent by certified mail within 30 days, with notice of right to review photographic/electronic evidence and information about hearing procedures included with the violation notice.

• Restricts use of funds retained by counties and municipalities from traffic infraction detector violations to only public safety initiatives and costs related to administering the Mark Wandall Traffic Safety Program.

• Establishes reporting requirements for counties and municipalities operating traffic infraction detectors, with penalties for noncompliance including mandatory remission of retained revenues to the Department of Revenue.

• Authorizes the Department of Transportation to inspect traffic infraction detectors and traffic control devices at intersections with detectors to verify compliance with specifications.

• Requires counties and municipalities to document consideration and rejection of engineering countermeasures before installing traffic infraction detectors, and prohibits citations issued by non-compliant devices.

• Effective date: July 1, 2015.
