Carl Abbott, age 67 at the time of the accident, suffered traumatic brain injury, subdural hematoma, right-sided paralysis, loss of cognitive function, and required nursing home care until his death in June 2014

Payment structured as annual installments of $211,111.11 from fiscal year 2015 through 2022, with a final payment of $211,111.12 in fiscal year 2023-2024

Due to Carl Abbott's death before or within 3 years of the act's effective date, the guardian is guaranteed a reduced total payment of $633,333.33, representing three annual payments

Attorney fees, lobbying fees, costs, and related expenses are capped at 25 percent of the total amount awarded under the act
