Michael Rardin, a 42-year-old construction employee earning a six-figure salary, suffered permanent hypoxic brain injury after hospital staff failed to properly monitor him as a critical patient and delayed intubation for approximately 2 hours

The negligence included failure to place the patient on cardiac/respiratory monitors, a failed first intubation attempt that delivered oxygen to his stomach instead of lungs, and approximately 10 minutes without sufficient oxygen to his brain

The total settlement is $2.2 million, with $200,000 already paid under the statutory liability limits of section 768.28, Florida Statutes

Attorney fees, lobbying fees, costs, and similar expenses are capped at 25 percent of the $2 million award
