Body camera recordings are classified as confidential and exempt from public records requirements when taken inside private residences, healthcare/mental health/social services facilities, or places where a reasonable person would expect privacy

Law enforcement agencies must retain body camera recordings for a minimum of 90 days

Recordings must be disclosed to persons depicted in the recording, their personal representatives, or residents of locations shown in the footage, limited to portions relevant to their presence

Courts may order disclosure after considering factors including compelling interest, sensitivity of information, potential harm to persons depicted, safety concerns, and whether redaction could protect privacy

The exemption applies retroactively and is subject to repeal on October 2, 2020, unless reenacted by the Legislature under the Open Government Sunset Review Act
