Exempts unlicensed persons from criminal penalties for carrying concealed weapons or firearms while evacuating during a mandatory evacuation order issued under a declared state of emergency.

Defines "in the act of evacuating" as immediate and urgent movement away from an evacuation zone within 48 hours after a mandatory evacuation order is issued, with the 48-hour period extendable by gubernatorial order.

Applies exemption to persons carrying concealed weapons or to persons lawfully possessing firearms who carry them concealed during qualifying evacuations.

Maintains existing exemptions for persons carrying self-defense chemical spray or nonlethal stun guns for defensive purposes.

Preserves existing criminal penalties for using evacuation exemptions or other weapons during commission of specified firearm-related crimes or other criminal offenses.
