CS for SB 682 - Transitional Living Facilities

• Creates Part XI of Chapter 400, F.S. establishing licensure requirements for transitional living facilities serving individuals with brain or spinal cord injuries, with base license fee of $4,588 plus $90 per-bed per biennium.

• Requires facilities to obtain accreditation from specialized rehabilitation facilities within 12 months of initial licensure and maintain compliance with state standards for client care, treatment plans, and discharge procedures.

• Establishes client rights including safe living environment, communication access, grievance procedures, and prohibits retaliation against clients or representatives who file complaints or appear as witnesses.

• Regulates use of physical restraints, chemical restraints, and seclusion as emergency safety measures only, with emergency treatment orders limited to 24 hours and requirements for notification of client representatives.

• Authorizes Agency for Health Care Administration to adopt rules, impose administrative fines ($500-$10,000 depending on violation class), and requires facilities licensed before July 1, 2015 to transition to new licensing structure by July 1, 2016.
