Exempts persons who sell, transfer, or arrange transfer of recycled and recovered materials to facilities for reclamation, recycling, manufacturing, or reuse from liability for hazardous substances released from those facilities.

Liability exemption does not apply if the person fails to exercise reasonable care in managing the materials or if the recycling arrangement was not reasonably expected to be legitimate based on available information.

Defines "recycled and recovered materials" as scrap paper, plastic, glass, textiles, rubber (excluding whole tires), metal, and spent lead-acid or nickel-cadmium batteries, including minor incidental materials from normal use but excluding hazardous waste.

Applies to causes of action accruing on or after July 1, 2015, and retroactively to causes of action accruing before July 1, 2015, for which lawsuits have not been filed.

Takes effect July 1, 2015.
