Commercial and industrial business owners or contracted third parties may install and operate renewable energy devices on their structures or leased property and sell the generated electricity to adjacent businesses without regulatory oversight.

Electricity sales from such renewable energy devices to immediately adjacent, same-parcel, or nearby businesses are exempt from classification as retail electricity sales and do not subject the energy-producing business to Public Service Commission regulation.

Utilities may recover the full actual cost of providing backup generation, transmission, or other related services to energy-producing businesses or their customers who reduce electricity purchases.

If the Public Service Commission determines that renewable energy adoption significantly reduces customer electricity purchases and adversely affects rates for other customers, utilities may recover fixed capacity and distribution costs from renewable energy users with super-majority PSC approval; customers may challenge excessive cost recovery and receive refunds.

Renewable energy rebates or incentive programs are the sole property of the renewable energy device owner; customers purchasing electricity from such devices are ineligible for rebates unless they also own the device.
