SB 1164 Summary

• Allows individuals previously adjudicated guilty of driving under the influence to petition for expunction of criminal history records for subsequent offenses if they otherwise meet expunction requirements.

• Permits expunction of subsequent offense records only if the subsequent offense itself is not prohibited from expunction under Florida law.

• Adds new subsection (6) to section 943.0585, Florida Statutes, establishing the exception for DUI-adjudicated individuals.

• Takes effect July 1, 2015.
