SB 1176 - Recreational Marijuana

• Legalizes recreational marijuana for adults 21+ to possess up to 2.5 ounces, grow up to 6 plants at home, and purchase from licensed retail stores

• Imposes $50 per ounce excise tax on marijuana sales from cultivation facilities to retailers/manufacturers, with annual inflation adjustments starting in 2017

• Establishes Division of Alcoholic Beverages, Marijuana, and Tobacco to license and regulate marijuana establishments (cultivation facilities, testing facilities, product manufacturing facilities, and retail stores)

• Prohibits minors from accessing marijuana with civil penalties of $200-$600 for using false identification; restricts retail locations to 500 feet from schools and prohibits sales 1 a.m.-6 a.m.

• Allows municipalities to prohibit marijuana businesses or cap retail locations (one store per 5,000 residents in areas over 20,000 population) through local ordinance, with application processing by division or locality by January 1, 2017
