CS/HB 89 Summary

• Defines "lawfully residing child" as a child lawfully present in the United States who meets Medicaid or CHIP residency requirements and is eligible for federal medical assistance under the Children's Health Insurance Program Reauthorization Act of 2009.

• Removes the definition of "qualified alien" and replaces it with "lawfully residing child" throughout Florida Kidcare eligibility provisions, explicitly excluding undocumented immigrants from eligibility.

• Allows optional Medicaid payments for children under 19 who would qualify for Medicaid except that they are lawfully residing children, while clarifying that undocumented immigrants are excluded from optional Medicaid benefits.

• Modifies Florida Healthy Kids Corporation eligibility to cover legal aliens currently enrolled as of January 31, 2004 who do not qualify for Title XXI federal funds because they are not lawfully residing children.

• Appropriates $28,538,785 from the Medical Care Trust Fund and $296,429 from the Grants and Donations Trust Fund for fiscal year 2016-2017 to the Agency for Health Care Administration, effective July 1, 2016.
