CS/CS/HB 95 - Public-Private Partnerships Summary

• Transfers and renumbers section 287.05712 to section 255.065 of Florida Statutes and revises public-private partnership (PPP) procedures for qualifying projects including transportation, water, educational, and government facilities.

• Requires private entities submitting unsolicited proposals to pay an initial application fee plus additional costs if the fee does not cover evaluation expenses; eliminates the Public-Private Partnership Guidelines Task Force.

• Deletes requirement for local governing body approval before school boards enter comprehensive agreements; revises approval conditions to focus on public interest, facility ownership, safeguards, and cost-effectiveness.

• Restricts financing agreement provisions that could result in loss of public entity ownership of real or personal property; authorizes negotiated revenue sharing from fee-generating facilities returned to the responsible public entity.

• Effective date July 1, 2016; provides Department of Management Services duties regarding comprehensive agreements and maintains sovereign immunity protections for public entities.
