HB 97 Summary

• Amends s. 287.05712, F.S. to create public records and public meetings exemptions for unsolicited proposals in public-private partnership projects.

• Unsolicited proposals are exempt from public records disclosure until the responsible public entity provides notice of an intended decision, with exemption ceasing no later than 90 days after rejection of all competitive solicitation proposals or 180 days after receipt if no competitive solicitation is issued.

• Portions of public meetings during which exempt proposals are discussed are exempt from public meetings requirements, and complete recordings must be made with no portion held off the record.

• Recordings and records generated during closed meetings are exempt from public disclosure under the same timeline as the proposals themselves.

• Exemptions are subject to the Open Government Sunset Review Act and will be repealed October 2, 2021, unless the Legislature reenacts them; effective date is contingent on HB 95 or similar legislation becoming law.
