HB 199 Summary

• Creates new section 215.4725 requiring all public entity contracts for supplies, services, information technology, or construction to include a representation that the business is not engaged in boycotts of persons or entities based on race, color, religion, gender, or national origin in jurisdictions with which the state has open trade.

• Exempts contracts where a business provides goods or services at least 20 percent less than the next lowest bidder, or contracts with a total potential value under $10,000.

• Prohibits companies appearing on the Scrutinized Companies with Activities in the Iran Petroleum Energy Sector List from contracting with the state beginning 90 days after notification, with limited exceptions for pre-January 1, 2016 investments with formal cessation plans or if state agencies determine services are necessary.

• Requires companies seeking state contracts to certify they or any assignee do not appear on the Iran sanctions list and prohibits contractors from subcontracting with companies on that list; state agencies may impose sanctions or declare contractors in default if they violate this requirement.

• Requires bidders on competitive bids to submit sworn statements certifying non-appearance on the Iran sanctions list, with allowance for electronic submission and exceptions for investments made before January 1, 2016 with cessation plans.

• Effective date: July 1, 2016.
