Department of Business and Professional Regulation imposes a $5 special fee per licensee upon initial licensure and each renewal to fund unlicensed activity enforcement efforts.

Department may not impose the special fee on license renewals for professions whose unlicensed activity account balance exceeds twice the total expenditures for unlicensed activity enforcement in the preceding 2 fiscal years.

Fee waiver applies to all licensees within a profession and cannot resume until the renewal cycle has ended for all licensees in that profession; waiver does not apply if the profession has a deficit or projected deficit in the next 5 fiscal years.

Department shall make direct charges by profession without allocating indirect overhead costs and must credit revenues from enforcement efforts directly to the appropriate profession's account.

Remaining balances in unlicensed activity accounts at the end of a renewal cycle may be transferred to the operating fund account with concurrence of the applicable board and department.
