CS/HB 351 - Contaminated Sites

• Defines "background concentration" as naturally occurring contaminants or those from anthropogenic impacts unrelated to site discharge, and "long-term natural attenuation" as natural attenuation approved by the department for periods exceeding 5 years

• Exempts nonprogram petroleum-contaminated sites from risk-based corrective action principles unless the responsible party requests their application

• Requires the Department of Environmental Protection to include protocols for long-term natural attenuation where site conditions warrant and mandates consideration of interactive (additive, synergistic, and antagonistic) effects of contaminants in cleanup criteria

• Authorizes use of site-specific or other relevant data and information when assessing cleanup target levels, and eliminates institutional control requirements when alternative cleanup target levels are used under specified circumstances

• Effective July 1, 2016
