CS/CS/HB 509 - Transportation Network Companies

• Requires transportation network companies to obtain annual state permits ($5,000 fee) and maintain agents for service of process in Florida.

• Establishes insurance requirements: $50,000/$100,000/$25,000 liability coverage when driver is logged in but not actively transporting riders; $1 million coverage when actively providing rides (effective March 1, 2017).

• Classifies drivers as independent contractors if company does not prescribe work hours, restrict multi-app use, assign territories, or prevent other employment.

• Mandates driver background checks including criminal records, sex offender registry, and driving history; prohibits drivers with more than 3 moving violations in 3 years, DUI convictions in past 7 years, or age under 19.

• Preempts local regulation by prohibiting counties, cities, and other entities from imposing taxes, licenses, or operational requirements on transportation network companies, drivers, or vehicles.
