CS/CS/HB 559 - Self-Service Storage Facilities

• Allows self-service storage facility owners to advertise property sales on a state website developed by the Department of Financial Services and Chief Financial Officer for 14 consecutive days, or alternatively publish in newspapers for 2 consecutive weeks.

• Permits lien sales to be conducted on public websites that customarily conduct personal property auctions, without requiring the facility owner to be licensed for online sales.

• Limits the Chief Financial Officer's liability for technical failures or content defects in notices posted on the state website.

• Requires facility owners to search motor vehicle and watercraft ownership databases, then send certified mail notice to owners and lienholders within 10 days before selling vehicles or watercraft, allowing 30 days for payment to satisfy the lien.

• Requires the Department of Financial Services to develop and maintain an Internet website providing public notice of self-service storage facility property sales, with fees established to cover website costs deposited into the Administrative Trust Fund.

• Effective date: July 1, 2016.
