CS/CS/HB 675 - Rule of Law Adherence Act

• Creates Chapter 908, Florida Statutes establishing that state entities, local governments, and law enforcement agencies must comply with and support federal immigration law enforcement, including complying with immigration detainers.

• Prohibits "sanctuary policies" defined as laws or practices that restrict communication or cooperation with federal immigration agencies regarding immigration status, and requires existing sanctuary policies to be repealed within 90 days of enactment.

• Establishes civil penalties of $1,000 to $5,000 per day for violations, requires reporting of violations to the Attorney General, and provides whistleblower protections for employees reporting violations; sanctuary policymakers may be suspended or removed from office.

• Permits law enforcement agencies to transport unauthorized aliens to federal facilities with judicial authorization, allows recovery of detention costs, and exempts crime victims and witnesses from immigration status reporting if they cooperate in investigations.

• Creates a private right of action for persons injured by aliens unlawfully present in the United States when a sanctuary policy violation allowed that alien access to the injured person; trial by jury is guaranteed in such cases.
