CS/CS/HB 739 - Secondhand Dealers

• Requires secondhand dealer transaction records to include digital photographs of items and allows alternative identification methods (IMEI, MEID, or manufacturer-assigned numbers) when standard serial numbers are unavailable.

• Establishes "automated kiosk" definition with required features including live remote monitoring, identity verification, serial number reading, stolen item database comparison, secure storage, and image capture during transactions.

• Extends holding periods for secondhand goods to 30 calendar days for items acquired through automated kiosks and defines "antique" as items at least 30 years old with special value due to age.

• Authorizes replevin actions against secondhand dealers based on right of possession to stolen goods with expedited summary procedures; establishes noncriminal violation with up to $2,500 fine if dealer fails to return property after written demand with proof of ownership.

• Permits secondhand dealers to store goods outside law enforcement jurisdiction only with written agreement and proof of ability to deliver goods within 2 business days upon request; holding period requirements do not begin until all required reports are submitted to law enforcement.
