CS/CS/HB 743 - Mobile Homes Summary

• Requires Division of Florida Condominiums, Timeshares, and Mobile Homes to adopt rules for board member training programs and publish notice of proposed rules by October 1, 2016.

• Authorizes mobile home park owners to pass non-ad valorem assessments to tenants if disclosed in prospectus or rental agreement, and requires park owners provide 90-day notice before increasing lot rental amounts.

• Allows mobile home purchasers to cancel or rescind purchase contracts if park owner does not approve tenancy within 5 days before closing.

• Permits mobile home owners to become association members upon incorporation with two-thirds consent, and allows members to vote by secret ballot and absentee ballot in association meetings.

• Prohibits tape recording or videotaping of meetings between association board/committees and park owner, and delays compliance deadline for board member training requirements until October 1, 2017.
