CS/CS/HB 791 - Local Tax Referenda

• Prohibits local government discretionary sales surtax referenda from being held during special elections.

• Referenda held at presidential preference primary or primary elections require approval of at least 60 percent of voters voting on the ballot question.

• Referenda held at general elections require approval of a majority of voters voting on the ballot question.

• Amends section 212.055, Florida Statutes, regarding various discretionary sales surtax authorizations for charter counties, regional transportation systems, infrastructure, small counties, indigent care, trauma centers, public hospitals, school capital outlay, and emergency fire rescue services.

• Effective date: July 1, 2017.
