Reduces the acreage threshold for state programmatic general permits for dredge and fill activities from 10 acres to 3 acres or less of wetlands or other surface waters.

Requires applicants seeking to use the statewide programmatic general permit to consent to applicable federal wetland jurisdiction criteria under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899.

Authorizes the Department of Environmental Protection to pursue regional general permits or delegation and assumption of federal permitting programs for dredged or fill material discharges.

Permits the department to delegate federal permitting authority without being limited to state-level criteria, provided the assumption encompasses all dredge and fill activities in jurisdictional wetlands or waters statewide.

Takes effect upon becoming law.
