CS/CS/HB 869 - Public Records Security Exemptions

• Amends Florida Statutes section 119.071 to revise exceptions to the public records exemption for security system plans held by state and local agencies, allowing disclosure to another state or federal agency to prevent, detect, guard against, respond to, investigate, or manage consequences of terrorism or to prosecute responsible persons.

• Defines "security system plan" to include records, photographs, diagrams, surveys, threat assessments, threat response plans, emergency evacuation plans, sheltering arrangements, and security training manuals relating to physical security of facilities.

• Makes security system plans for state/political subdivision property or privately owned/leased property held by agencies confidential and exempt from public records disclosure, with exemption applying retroactively to plans held before, on, or after the effective date.

• Permits disclosure of confidential security information to property owners/leaseholders, agencies carrying out official duties, and other state or federal agencies for official purposes, or upon court order showing good cause.

• Amends section 281.301 to add similar exceptions allowing disclosure to another state or federal agency for terrorism prevention, detection, investigation, and prosecution purposes.

• Effective upon becoming law.
