Prohibits persons who publish or disseminate arrest booking photographs through publicly accessible print or electronic media from soliciting or accepting payment to remove, correct, or modify such photographs.

Allows aggrieved persons to file civil actions for violations, with remedies including injunctive relief, civil penalties of up to $1,000 per day for noncompliance with court orders, actual monetary damages, and attorney fees and costs.

Exempts settlement-related fees and attorney costs in connection with lawsuits, arbitration claims, or other judicial proceedings from the prohibition on accepting payment.

Prohibits criminal justice agencies from electronically publishing arrest booking photographs of individuals charged with but not yet convicted of criminal offenses, except when published to governmental entities, third-party criminal justice service providers, or when the agency head determines publication is necessary to protect public safety.

Takes effect October 1, 2016.
