New rulemaking authority is suspended 4 years after enactment unless reauthorized by general law; existing authority effective before July 1, 2016, is suspended July 1, 2020.

Reauthorized rulemaking authority expires July 1 of the 4th calendar year following reauthorization, after which it suspends until reauthorized again.

Rules adopted during suspended rulemaking authority do not take effect unless ratified by the Legislature, except when the Governor declares a public necessity to delay suspension for up to 90 days.

The President of the Senate and Speaker of the House may appoint a joint committee to oversee rulemaking authority review and receive annual reports on reauthorization recommendations.

Agencies must notify the Legislature by October 1 each year of any rulemaking authority subject to suspension within the next 2 years, and lawfully adopted rules remain in effect during suspension periods.
