HB 1099 Summary

• Exempts trade secret information in annual recycling reports submitted by private businesses to counties from public records requirements under Florida Statutes section 403.7032

• Applies exemption to private businesses (other than certified recovered materials dealers) reporting on recyclable materials including paper, metals, glass, plastics, textiles, rubber materials, and mulch

• Exemption is subject to the Open Government Sunset Review Act and automatically repeals on October 2, 2021, unless the Legislature reviews and reenacts it

• Exemption justified to encourage business participation in voluntary recycling reporting programs by protecting proprietary information that could harm competitive interests

• Effective date is October 1, 2016
