Redefines "children with special health care needs" as those under 21 with a chronic or serious physical, developmental, behavioral, or emotional condition (changing from "and" to "or")

Requires the Department of Health to develop a clinical eligibility instrument to determine if children qualify for the Children's Medical Services program

Removes the requirement that program eligibility be based on "diagnosis of one or more chronic and serious medical conditions," replacing it with the new clinical eligibility process

Mandates that parents/guardians be notified of the right to appeal clinical ineligibility determinations under Chapter 120 administrative procedures

Exempts the Children's Medical Services Network from the 10% regional enrollment cap that applies to other specialty plans under Medicaid managed care
