HB 1275 - Domestic Partnerships

• Creates comprehensive domestic partnership registration system in Florida requiring filing of Declaration of Domestic Partnership with circuit court clerk for $30 fee, with additional fees deposited into Domestic Violence Trust Fund and Displaced Homemaker Trust Fund.

• Grants domestic partners legal rights comparable to spouses including visitation rights in health care facilities and correctional institutions, joint property ownership by tenancy by the entirety, health care proxy authority, and authority to direct disposition of deceased partner's body.

• Establishes domestic partnership requirements: both parties 18+ years old, at least one Florida resident, shared mutual residence, and prohibition on partnerships if either party is married, already in a domestic partnership, or related by blood.

• Extends domestic partner recognition across multiple Florida statutes governing medical decisions, brain death notification, nursing home residency, anatomical gifts, funeral arrangements, and autopsy authorization.

• Allows termination of domestic partnership by filing Notice of Termination with $10 fee; partnership automatically terminates 90 days after filing or upon death of partner, though surviving partner retains rights regarding deceased partner's medical records and body disposition; effective July 1, 2016.
