HB 1423 Summary

• Deletes legislative intent provision regarding background screening for certain not-for-profit membership organizations in child care facilities statute.

• Creates section 1006.05 defining "not-for-profit organization or municipal government" to include after-school programs for ages 6-18 that operate 5+ days per week, charge nominal or no fees, and provide homework help and character development.

• Exempts qualifying not-for-profit organizations and municipal governments from child care facility licensing requirements under sections 402.305-402.319, though employees working directly with children must still meet background screening requirements under sections 435.04 and 435.12.

• Adds "any other division within the Department of Education that conducts background screenings for after-school programs operated by not-for-profit organizations" to the definition of "specified agency" in section 435.02.

• Creates 7-member Not-for-Profit After-school Program Standards Study Group to recommend minimum health, sanitation, and safety standards, with report due to Governor and Legislature by January 1, 2017.
