HB 7071 - Public Corruption Summary

• Adds definition of "corruptly" or "with corrupt intent" to mean acting knowingly and dishonestly for a wrongful purpose.

• Establishes "public contractor" definition to include persons and their officers/employees who have contracts with governmental entities for purposes of official misconduct and bid tampering statutes.

• Revises bribery (s. 838.015), unlawful compensation (s. 838.016), official misconduct (s. 838.022), and bid tampering (s. 838.22) statutes to replace "corruptly" language with "knowingly and intentionally" while maintaining corrupt intent requirements.

• Expands official misconduct and bid tampering provisions to apply to public contractors in addition to public servants.

• Effective date: October 1, 2016.
