Creates automatic qualification for expunction of criminal history records for persons not found guilty, including cases where no charging document was filed, charges were dismissed, or the person was acquitted.

Prohibits automatic expunction if the person was adjudicated guilty or delinquent for any acts stemming from the arrest or alleged criminal activity.

Eliminates the requirement for a certificate of eligibility from the department and allows courts to order expunction without requiring agencies to become parties to the proceeding.

Requires courts, clerks, state attorneys, arresting agencies, and the department to distribute expunction orders to all agencies that received the criminal history record information.

Permits persons receiving expunction relief under this section to still petition for expunction or sealing under other existing provisions if otherwise eligible, and takes effect July 1, 2016.
