SB 1072 Summary

• Prohibits persons publishing or disseminating arrest booking photographs through publicly accessible print or electronic media from soliciting or accepting payment to remove, correct, or modify such photographs.

• Allows arrestees to bring legal action to enjoin publication of their arrest booking photograph if this prohibition is violated.

• Requires courts to order removal of enjoined photographs within 14 days and impose a civil penalty of $1,000 per day for noncompliance.

• Entitles prevailing arrestees to recover reasonable attorney fees and costs related to obtaining the injunction and any appeals.

• Does not apply to government entities at any level (state, regional, county, local, or municipal) or their departments and divisions.

• Effective October 1, 2016.
