Health care practitioners licensed to prescribe medicinal drugs or controlled substances may include the patient's medical condition on written or electronic prescriptions upon patient request.

Pharmacists or dispensing practitioners must include the medical condition on the label of the dispensing container if directed by the prescriber.

The prescriber must first obtain a written or verbal waiver from the patient or legal representative, documented in medical records, acknowledging the waiver of privacy rights under the Health Insurance Portability and Accountability Act (HIPAA) or successor acts.

The waiver must specifically authorize the inclusion of the patient's medical condition on both the prescription and the dispensing container label.
