SB 1666 - Domestic Partnerships

• Establishes a domestic partnership registry in Florida allowing two unmarried individuals aged 18+ who share a mutual residence to file a Declaration of Domestic Partnership with a circuit court clerk for a $30 fee, with additional fees directed to the Domestic Violence Trust Fund and Displaced Homemaker Trust Fund.

• Grants domestic partners visitation rights in health care facilities and correctional institutions equal to spouses, and allows them to serve as health care proxies, make anatomical gifts, and direct disposition of remains without a separate health care surrogate designation.

• Requires health care facilities and nursing homes to allow domestic partners access to patients/residents and to share rooms, and mandates notification of domestic partners in cases of brain death, medical records access, and emergency situations.

• Prohibits domestic partnerships where either party is married, already in a domestic partnership, under age 18, incapacitated, related by blood/marriage within prohibited degrees, or if consent was obtained by force, fraud, or duress.

• Allows termination of domestic partnerships by filing a Notice of Termination with a circuit court clerk for a $10 fee, effective 90 days after filing, with automatic termination upon marriage or death of either partner.
