CS/HB 141 - Craft Distilleries Summary

• Craft distilleries may sell factory-sealed spirits to consumers at on-premises souvenir gift shops only in face-to-face transactions, limited to a maximum of six individual containers per customer per branded product per calendar year.

• Souvenir gift shop sales are restricted to private property contiguous to the distillery's licensed premises as defined in the original license application, with division approval required for any location changes.

• Craft distilleries must report to the division within 5 days of reaching production limitations and are prohibited from selling to consumers beginning the day after reaching the production cap.

• Craft distilleries may not ship spirits to consumers but may ship only to manufacturers, wholesale distributors, bonded warehouses, and exporters; all consumer sales must occur in-state through face-to-face transactions.

• License transfers and ownership interests in distilleries producing 75,000 or fewer gallons annually are prohibited to entities with direct or indirect ownership in other distilleries, and craft distilleries cannot be affiliated with other distilleries unless each produces 75,000 or fewer gallons per year.
