HB 167 Summary

• Creates Florida Statute 790.30 prohibiting sale, transfer, and possession of assault weapons and large capacity magazines (defined as those holding more than 7 rounds) with mandatory minimum prison sentences of 2 years for sales and 1 year for possession violations.

• Allows persons who lawfully possessed assault weapons or large capacity magazines before October 1, 2017, to register them with the Department of Law Enforcement by October 1, 2018, and restricts transfers to licensed gun dealers, bequest, or intestate succession only.

• Permits registered owners to possess certified weapons only at residences, places of business, target ranges, shooting clubs, or firearm-related educational events, and requires safe transportation in trunks or locked containers.

• Establishes enhanced criminal penalties with mandatory minimum sentences of 15-25 years imprisonment when certain felonies are committed with an assault weapon or large capacity magazine.

• Exempts law enforcement agencies, military personnel, permanently inoperable firearms, and manufacturers producing weapons for out-of-state sale; takes effect October 1, 2017.
