Creates section 390.305 of Florida Statutes to make physician abortion reports filed with the Department of Health confidential and exempt from public records disclosure under Florida Statutes section 119.07(1) and Florida Constitution Article I, section 24(a)

Permits disclosure of physician abortion reports only to the Attorney General or state attorney with appropriate jurisdiction for criminal investigations under sections 390.301(6) or (7)(b), or pursuant to court order in actions under section 390.301(7)

Applies the exemption retroactively to all physician abortion reports filed with the department before, on, or after January 1, 2018

Exemption is subject to the Open Government Sunset Review Act and shall stand repealed on October 2, 2022, unless reenacted by the Legislature

Effective date is contingent upon HB 203 or similar legislation becoming law in the same legislative session
