Department of Agriculture and Consumer Services must deny or refuse to renew registration of movers or moving brokers that have not satisfied civil penalties or administrative fines for failing to disclose criminal history information.

Movers and moving brokers are prohibited from knowingly refusing or failing to disclose in writing to customers that employees or subcontractors with access to the customer's dwelling have been convicted of felonies listed in s. 775.21(4)(a)1. or similar offenses from other jurisdictions.

Department must impose a Class IV administrative fine for each violation of the criminal disclosure requirement if no civil penalty is sought for the same offense.

Department must seek a Class IV civil penalty for each violation of the criminal disclosure requirement if no administrative fine is imposed for the same offense.

Effective date is October 1, 2017.
