Creates Florida Statute 901.40 to establish a framework for voluntary prearrest diversion programs for adults who commit qualifying misdemeanor offenses.

Authorizes law enforcement officers to issue civil citations or prearrest diversion notices to adults who do not contest the offense and have no prior arrest or citation history, at officers' sole discretion.

Requires participants to complete intake, perform community service hours specified by the program, pay victim restitution, and receive assessment, intervention, education, and behavioral health care services.

Allows law enforcement to pursue criminal charges and prosecution if an adult fails to complete the program; successful completion prevents an arrest record from being associated with the offense.

Requires law enforcement agencies, program services providers, public defenders, state attorneys, and circuit court clerks to develop program policies, procedures, and eligibility criteria; effective date is July 1, 2017.
