The Department of Highway Safety and Motor Vehicles, in collaboration with the Agency for State Technology, shall establish protocols and standards for issuing an optional digital proof of driver license and procure necessary application programming interfaces for private entities to manufacture digital proofs.

The Agency for State Technology must maintain and publish protocols and standards on its website, review private entity requests for authorized access to interfaces, and designate approved private entities as authorized manufacturers of digital proofs of driver licenses.

Authorized manufacturers must collect revenue from sales or renewals of digital proofs and remit 50 percent of all revenue collected to the Highway Safety Operating Trust Fund.

Presenting an electronic device displaying a digital proof of driver license does not constitute consent for law enforcement to access any other information on the device, and the person presenting the device assumes liability for any resulting damage.

The act takes effect October 1, 2017.
