CS/HB 697 - Rule of Law Adherence Act

• Creates Chapter 908, Florida Statutes, establishing state requirements for compliance with federal immigration enforcement and prohibition of "sanctuary policies" by state entities, local governments, and law enforcement agencies.

• Requires law enforcement agencies to comply with federal immigration detainers, notify federal immigration authorities of arrested persons unable to prove lawful presence, and report immigration status to judges and in case files.

• Prohibits state and local entities from restricting communication or cooperation with federal immigration agencies regarding immigration status, with exceptions only for crime victims or witnesses who cooperate in good faith.

• Establishes enforcement mechanisms including complaints to the Attorney General, civil penalties of $1,000-$5,000 per day for violations, injunctive relief, ineligibility for state grant funding for 5 years, and a private cause of action for injuries caused by sanctuary policies.

• Existing sanctuary policies must be repealed within 90 days of the act's effective date (July 1, 2017), with enforcement provisions taking effect October 1, 2017.
