HB 893 - Correctional Privatization Summary

• Transfers duties of the Department of Management Services concerning private correctional facilities to the Department of Corrections.

• Requires private correctional contracts to demonstrate at least 7 percent cost savings over public facility provision, with costs certified by the Auditor General.

• Removes Department of Management Services approval requirement for temporary control of private facilities during emergencies involving serious threats to safety, health, or security.

• Establishes that Department of Corrections must provide facility assignment decisions for inmates and develop cooperative agreements with contractors for inmate transfers between facilities.

• Takes effect July 1, 2017.
