HB 1001 Summary

• Directors or officers charged by information or indictment with felony theft or embezzlement involving association funds must be removed from office immediately, with a vacancy filled according to law until charges are resolved or term ends.

• If charges are resolved without a finding of guilt, the removed director or officer is reinstated for the remainder of their term.

• Directors or officers determined by the board or division to have knowingly violated association bylaws or chapter provisions are liable for fines: $250 for first violation, $500 for second violation, and $1,000 for third or subsequent violations.

• The Division of Florida Condominiums, Timeshares, and Mobile Homes may recall a director or officer following a third or subsequent violation by order.

• Effective date: July 1, 2017.
