HB 1113 Summary

• Requires private firearm sales, leases, and transfers between unlicensed parties to be completed through a licensed dealer who processes the transaction as the seller.

• Allows unlicensed sellers to remove the firearm during the background check and waiting period, then complete the transaction directly with the buyer once cleared.

• Permits licensed dealers to charge buyers a fee for administrative costs of facilitating private firearm transfers, in addition to existing federal and state fees.

• Applies the mandatory 3-day waiting period (excluding weekends and holidays) to private handgun sales facilitated through licensed dealers, not just retail sales.

• Takes effect July 1, 2017.
