CS/HB 1163 - Agency Rulemaking Summary

• Requires agencies to include agency website addresses in notices of intended action where statements of estimated regulatory costs can be viewed in their entirety.

• Mandates agencies prepare statements of estimated regulatory costs before adopting or amending any rule (other than emergency rules) if the rule will adversely impact small businesses or increase regulatory costs exceeding $200,000 in aggregate within 1 year of implementation.

• Requires agencies to prepare statements of estimated regulatory costs before repealing a rule only if the repeal would impose regulatory costs; makes rule repeals presumptively correct in legal challenges.

• Directs the Department of State to include agency website addresses on the Florida Administrative Register website where regulatory cost statements can be viewed in full.

• Requires agencies to provide notice of revision to the Department of State when they revise an estimated regulatory cost statement for publication in the Florida Administrative Register.

• Effective date: July 1, 2017.
